§ 2-602. Affirmative action and equal opportunity program.

  • (a)

    The purpose of the affirmative action program provided in this section is to provide equal employment and business opportunity for all persons, partnerships, companies and corporations and to prohibit discrimination in employment and business practices because of race, color, religion, sex or national origin, and to promote the full realization of equal business opportunity through a positive and continuing program within each department, agency, or component of the town.

    (b)

    The program is as follows:

    (1)

    The town shall abide by section 7-410 et seq. of this Code which provides for fair housing in the town, prohibiting discrimination in the sale or rental of housing, the financing of housing, and the provision of brokerage services;

    (2)

    The town shall abide by section 2-601 of this Code which provides for a declaration of the policy of the town with regard to Title VI of the Civil Rights Act of 1964, a declaration of compliance with provisions of that Title, and authorization for issuing assurances of compliance with that Title;

    (3)

    The town will continue to place all advertisements for employment in newspapers which serve the largest number of minority group people in the recruiting area, those newspapers being defined as "The Enterprise - Official Journal";

    (4)

    The town shall not discriminate against any employee or applicant for employment because of race, color, sex, religion or national origin and the directors will continue to see that the minorities and low income personnel of the town take full advantage of the school classes that are offered them;

    (5)

    The town officials shall (through investigation) see that minorities take full advantage of participation in any contracts or opportunities generated from any U.S. Department of Housing and Urban Development or town program;

    (6)

    All public contracts entered into by the town shall incorporate an equal employment opportunity clause which reads in part as follows: The contractor will not discriminate against any employee or applicant for employment because of race, color, religion, sex or national origin and the contractor will take affirmative action to insure that applicants are employed and that employees are treated during employment without regard to their race, color, religion, sex or national origin;

    (7)

    This affirmative action program applies to every contractor, subcontractor, or bidder holding or seeking a public contract with the town and intends to provide minority businesses in the town nonbid purchase orders up to legal non-bid limits;

    (8)

    The citizens' participation in the local governmental process is open to all citizens of the town rather than just appointing citizens to various boards. The mayor calls for total citizen participation by inviting everyone in the town to serve on any one of the mayor's advisory committees that are created to help make a better place for all;

    (9)

    If and when the town adopts a capital improvement budget, it will be available to all citizens so that they can see that the town is not discriminating in its capital improvement program;

    (10)

    The equal opportunity officer may, from time to time, make spot checks of town, contractor, or subcontractor compliance with the program;

    (11)

    The mayor of the town will make whatever changes or additions to this program which may become necessary in order to assure equal practices by the town.
